1. Agreement

This site is operated by HILLTOP ARMORY LLC, a licensed firearms dealer holding Federal Firearms Licence 5-43-119-01-6B-18066. By using the site or placing an order you accept these terms. If you do not accept them, do not use the site.

2. Eligibility and your warranties

By placing an order you warrant that:

• you are at least 18, and at least 21 where the order includes handgun ammunition, a handgun or any item for which law sets that age;
• you are not prohibited from receiving or possessing firearms or ammunition;
• you are buying for your own lawful use and not on behalf of another person;
• receipt at your delivery address is lawful where you live; and
• the information you give us is true and complete.

3. Orders and acceptance

Your order is an offer to buy. A contract forms when we accept it by despatching the goods, not when the site sends an automatic confirmation.

We may decline or cancel any order, in whole or part, including where:

• we cannot lawfully ship to your destination;
• an age or eligibility check is not satisfied;
• we believe the order is placed for a person who cannot lawfully buy;
• the item is out of stock or was listed at a manifestly incorrect price; or
• payment is not authorised or the order appears fraudulent.

Where we cancel, we refund in full and charge no fee.

4. Pricing and availability

Prices are in United States dollars and exclude delivery and tax unless stated. We price and describe carefully, but errors occur; where a price is obviously wrong we are not bound to supply at it and will contact you before charging. Stock is not reserved until an order is accepted.

5. Delivery and risk

Delivery terms, carriage restrictions and signature requirements are in our shipping policy, which forms part of these terms. State restrictions on ammunition are on the restrictions page.

Risk passes to you on delivery. Title passes when we receive payment in full. Firearms are delivered only to a licensed dealer in your state and released to you by that dealer after their own checks.

6. Returns

Our returns policy forms part of these terms. Ammunition, primers and powder are final sale once despatched, except where defective, damaged in transit, incorrectly supplied or recalled.

7. Safe use and your responsibility

Firearms and ammunition are dangerous if misused. You are responsible for safe handling, lawful storage, and for using ammunition only in a firearm in sound condition and correctly chambered for that cartridge. Follow the instructions supplied by the ammunition and firearm manufacturers.

Information on this site, including ballistic data and our storage guidance, is general information. It is not a substitute for the manufacturer’s instructions, professional training or legal advice.

8. Intellectual property

The content of this site is owned by us or our licensors and may not be copied or reused commercially without permission. Brand names and trade marks belong to their owners; we use them to identify the goods we sell.

9. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or for fraud.

Subject to that, and to the maximum extent the law allows, we are not liable for indirect or consequential loss, and our total liability arising out of an order is limited to the amount you paid for it. We are not liable for loss arising from your misuse of goods, unsafe storage, or failure to comply with the law where you live.

10. Governing law

These terms are governed by the laws of the State of Missouri and the federal law of the United States, and the courts of Missouri have jurisdiction.
